You agree to be bound by these Terms by:

a) using, browsing or accessing any part of the Website;

b) communicating with us through the Website; 

c) registering as a GAZCLUB program member through the Website; or

d) placing an Order through the Online Store. 

GAZMAN may from time to time review and update these Terms in our reasonable discretion, including to take account of any updates or changes to our Website, new laws, regulations, products or technology. Your use of the Website will be governed by the most recent Terms posted on the Website. By continuing to use the Website, you agree to be bound by the most recent Terms. It is your responsibility to check the Website regularly for updated versions of the Terms. The Website is subject to change at any time without notice. If we make significant changes to our Terms, we will seek to inform you by notice on our website or by email.  Signing up to the GAZCLUB program through the Website is also subject to the further terms and conditions which apply to that program, available at www.gazman.com.au/pages/terms-conditions. 

GAZMAN provides its Website visitors and GAZCLUB program members the opportunity to purchase goods from GAZMAN. By placing an Order to purchase goods via the Online Store, you are offering to purchase a product on and subject to these Terms. All Orders are subject to availability of the relevant goods, and we will take reasonable steps to ensure that our Website accurately reflects stock availability. 

To place an Order with GAZMAN you must be over 18 years of age and have a registered PayPal or Afterpay account, valid credit card or debit card issued by a bank or credit union acceptable to us.  

By placing an Order via the Online Store, you are making an offer and commitment to purchase the goods on these Terms. An Order is subject to acceptance or rejection by GAZMAN in our reasonable discretion after we receive the Order in Australia. Once you have placed an Order and the applicable payment is received by us, the Order cannot be cancelled by you (subject to section 6 “Returns and refunds of an Order”). 

Once you have placed an Order, we will send you an acknowledgement email confirming receipt of your Order. This email will only be an acknowledgement and will not constitute acceptance of your Order. We may reject an Order (in whole or in part) in our reasonable discretion, including (without limitation) due to unavailability of stock (despite us taking reasonable steps to ensure that our Website accurately reflects stock availability), if your payment has not been approved by us, if we reasonably suspect fraudulent conduct or we reasonably believe that your conduct violates applicable laws or third party rights. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card, nominated bank account, or PayPal or Afterpay account (as applicable).  

We will send you a second email confirming the Order once full payment for the Order has been received by GAZMAN and the Order has been dispatched (or is available at a physical GAZMAN store for Click & Collect). Once this has occurred, title in the goods passes to you as well as any risk of loss or damage. 

All prices are shown on our Website, and transactions are processed, in Australian Dollars (AUD). Prices are inclusive of goods and services tax. In all other respects, the price is exclusive of taxes, duties and charges imposed or levied in Australia or overseas in connection with the supply of goods or services. 

You should note that some countries have import restrictions on certain goods or services. If you are outside Australia, you will be responsible for checking whether such restrictions apply before placing an Order. If you are outside Australia you will become the importer and may be liable to pay local taxes or duties, and you will assume all liability under any customs or import laws and regulations that apply to you. 

Whilst we take reasonable steps to ensure that all details, descriptions and prices that appear on the Website and Online Store are accurate, errors may occasionally occur. We reserve the right, in our reasonable discretion, to reject or cancel Orders (in whole or in part) where there has been an error on our Website or Online Store affecting the Order, including in relation to the goods or price. We will notify you as soon as possible if there is an error affecting your Order and if we reasonably determine that the Order should be rejected or cancelled. If you have already paid for the goods, we will provide you with a full refund for the goods affected by the error based on your original method of purchase. 

If there is a pricing error, you will have the option to proceed with your Order at the correct price or cancel your Order. The Order will be automatically cancelled if we are unable to contact you, after making reasonable attempts, through the contact details provided by you in your Order. If you cancel your Order and you have already paid for the goods, we will provide you with a full refund based on your original method of purchase. 

To the extent permitted by law, GAZMAN reserves the right to update the prices of goods in our Online Store from time to time. Subject to the previous paragraph, the price that is displayed on our Website at the time you have completed your Order will be the most up to date price for the relevant goods. We reserve the right to change pricing and other information on the Website immediately without notice to you, including in the event of any errors.  

You may have consumer rights under statute, including under the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth), which may be relevant to your use of the Website, and goods that you purchase from us. Nothing in these Terms excludes or restricts those rights.  See www.accc.gov.au for more information about those rights. 

If there is a major failure with goods you purchase from us, you are entitled to choose a refund or replacement of the relevant goods. If there is a minor problem with the goods, you are entitled to have the failure rectified in a reasonable time (and if this does not occur, you are entitled to other remedies including a refund for the goods). You are also entitled to be compensated for reasonably foreseeable loss or damage as a result of a failure of GAZMAN to comply with a consumer guarantee under the Australian Consumer Law. 

If you are not satisfied with the quality of the goods or services you have purchased or you change your mind, you may contact GAZMAN using the details provided in the Order or at www.gazman.com.au/contact-us.  

Any remedy will be at GAZMAN's reasonable discretion, in accordance with our Returns Policy and applicable laws including the Australian Consumer Law.

Delivery and shipping of goods will be in accordance with our Shipping Policy.

While we aim to deliver your Order to you within the estimated delivery times as set out in our Shipping Policy, we cannot guarantee that your Order will be delivered within this timeframe. We do not control deliveries or delivery times once your Order has been dispatched from our warehouse.  

To the extent permitted by law, we will not be liable to you for any delay in delivering your Order. Processing may take longer during certain times of year.  

We are not responsible or liable for any delay or failure to deliver any products ordered from us as a result of any legal, customs or regulatory restrictions imposed by any countries. 

GAZMAN has the right to monitor Content made available on the Website. GAZMAN reserves the right, in its reasonable discretion, to block, modify or remove any Content contained on the Website without notice, and to the extent permitted by law, will not be liable in any way for possible consequences of such actions. 

The Content on the Website is for general information purposes only. Furthermore, subject to applicable law, GAZMAN does not warrant or make any representations as to any third-party products or services that may be described or referred to on the Website. Any use of the Content is at your own risk. 

The Content on this Website is obtained and developed from a variety of sources, including but not limited to, collaborations with third parties and information provided by third parties under a licence to us. Inclusion of Content on this Website is not an endorsement of any organisation, product or service. 

While reasonable care has been taken in preparing the Content on this Website, GAZMAN and its employees, related parties, directors, officers, agents, volunteers, contractors and subcontractors are not liable, to the maximum extent permitted by law, including for any loss or damage, resulting from the reliance on the Content, or for its accuracy, currency and completeness. 

You agree that you are solely responsible for any content that you communicate or otherwise provide over the Website. You warrant and represent that any content that you communicate or otherwise provide to us will not violate these Terms. 

If you have a complaint regarding any Content, GAZMAN's will review any written complaint notified to it and may, in its reasonable discretion, modify or remove the particular Content. If GAZMAN determines to not modify or remove that Content, we are not required to provide you with our decision.

The Website may contain links to third-party websites. GAZMAN provides those links as a ready reference for searching for third-party goods and services on the internet and not as an endorsement of those websites, their operators, or the goods, services or content that they describe. 

Other websites which are linked to on the Website (including Facebook and Instagram), are not covered by these Terms and will have their own terms and conditions and privacy policies. If you choose to access these linked sites, you do so at your own risk and you should carefully review the terms and conditions and privacy policies associated with those sites. Complaints, claims, concerns, or questions in relation to the third party’s website (or the goods, services or content they describe) should be directed to the relevant third-party. 

GAZMAN is not responsible for and will not be liable in respect of any harm in relation to the content or operation of those third-party websites or any of the goods, services or content that they include or describe (including any transactions for those goods or services). GAZMAN is not responsible for and will not be liable in respect of any incorrect link to an external website.  

You are not permitted to frame or link the Website for commercial activity or otherwise in violation of these Terms without GAZMAN's express written permission. 

From time to time, GAZMAN may run online-only sale events. These specific online-only sales are valid on the Website only and are not applicable or available in-store. Online sale events are strictly limited to selected marked items only on the Online Store and may be subject to time limits (as specified on the Online Store). 

Limited styles, stock and sizing may apply and some items may sell out before the end of the relevant sale. 

Subject to applicable law, GAZMAN does not warrant that you will have continuous access to the Website. GAZMAN will not be liable in the event that the Website is unavailable to you due to computer downtime attributable to malfunctions, upgrades, preventative or remedial maintenance activities, interruption in telecommunications supply or other circumstances beyond GAZMAN’s reasonable control. 

GAZMAN does not guarantee the security and delivery of communications over the internet as such communications rely on third-party service providers. Electronic communication (including electronic mail) is vulnerable to interception by third parties and GAZMAN does not guarantee the security of these communications, including over the Website. 

GAZMAN does not provide, and has no control over, communications, networks or services, the internet or other technology required or used across the Website and, to the extent permitted by law, accepts no responsibility for any direct or indirect loss in any form associated with them, whether due to congestion, technical malfunction, viruses or otherwise. 

For the purposes of this section, “intellectual property rights” includes rights in respect of intellectual property such as trade marks, designs, logos and copyright, which may include text, music, videos and images. 

All intellectual property rights in respect of (or where relevant, displayed on) the Website (including Content), GAZMAN's goods and services, and all components of them are owned by or licensed to GAZMAN or any of its related entities (Our IP).  

Our IP on the Website may also include the trademarks and logos, of GAZMAN and/or third parties which may be registered or otherwise protected by law.  

You must not copy, modify or transmit any part of the Website.  

GAZMAN grants you a limited, personal, revocable, non-exclusive, non-sublicensable and non-transferable licence to use the Website for your own personal use, and to use the GAZMAN IP for the sole purpose of accessing the Website, in accordance with these Terms and subject to the restrictions specified in clause 15. You may not download (other than page caching), modify, or copy the Website or any portion of the Website.  

You acknowledge that other than the express licence granted to you in this clause, you obtain no other rights, implied or otherwise, in respect of Our IP. 

Any Content that you post on the Website is subject to the restrictions specified in clause 15 below.  Any ideas, suggestions or feedback that you provide or communicate to GAZMAN (Feedback) will be treated as non-confidential and you agree that we may copy, amend and otherwise use the Feedback (and allow others to do so) for any purpose. These rights are perpetual, royalty free, world-wide, irrevocable and transferable.  

GAZMAN may at any time immediately terminate your access (including restricting access) to the Website or any feature of the Website where we reasonably suspect that you have breached these Terms. We will aim to notify you next time you access the Website (or if you are an existing customer, by using the email address you have provided to us).  

You may terminate these Terms at any time by ceasing to use this Website (provided you do not have any active Orders with us). 

Any indemnities given by you and any limitations of our liability in these Terms survive such termination, as well as any other provisions that would reasonably be expected to.
